2. Agreement to Terms
By accessing or using Euterpa Studios' website (euterpastudios.com) and services, you agree to be bound by these Terms of Service and all applicable laws and regulations, including French commercial law (Code de commerce) and consumer protection law (Code de la consommation).
If you do not agree with these Terms, you must not use our services.
3. Services Description
Euterpa Studios provides professional music production services worldwide, including but not limited to:
- Mixing: Professional audio mixing services
- Mastering: Audio mastering and finalization
- Full Production: Complete music production from start to finish
- Remix Services: Professional remixing of existing tracks
- Track Consultation: Expert advice and guidance on music projects
- Playlist Promotion: Music promotion and playlist submission services
All services are provided remotely via digital communication channels.
4. Professional Status and Applicable Law
EUTERPA MUSIC is registered in France and operates under French law. These Terms are governed by:
- French Commercial Code (Code de commerce)
- French Consumer Code (Code de la consommation) for B2C transactions
- French Civil Code (Code civil)
- EU Directive 2011/83/EU on consumer rights
- General Data Protection Regulation (GDPR)
Any dispute will be subject to the exclusive jurisdiction of French courts, specifically the courts of Marseille, France.
5. Pricing and Payment Terms
5.1 Pricing
All prices displayed on our website are in Euros (€) and include all applicable French taxes, including VAT (TVA) at the current rate of 20% for services provided in France and the EU.
For clients outside the EU, VAT may not apply (reverse charge mechanism or zero-rating may apply depending on location).
5.2 Payment Methods
We accept payment via:
- Credit/debit cards (processed securely through Stripe)
- Bank transfers if possible (for projects over €1000)
- Other payment methods such as Cryptocurrency may be available upon request o
5.3 Payment Schedule
All services require 100% payment upfront before work begins. No exceptions.
5.4 Invoicing
In accordance with French law (Article L441-9 of the Code de commerce), an invoice will be issued for all transactions and will include:
- Invoice number and date
- Complete identification of both parties
- Detailed description of services
- Unit prices and total amount
- VAT rate and amount
- Payment terms and late payment penalties
5.5 Late Payments
As per Article L441-10 of the French Commercial Code, late payments will incur:
- Interest at 3 times the legal interest rate in France
- A fixed recovery indemnity of €40
- Compensation for collection costs if applicable
6. Delivery of Services
6.1 Standard Delivery Times
Standard delivery times are estimates and may vary based on project complexity:
- Mixing: 3-5 business days
- Mastering: 3-5 business days
- Full Production: 2-4 weeks (depending on scope)
- Rush Service: 24-48 hours (additional fee applies)
6.2 Delivery Process
Delivery times commence after:
- Payment confirmation
- Receipt of all required materials in acceptable quality
- Written confirmation of project specifications
Completed work will be delivered via secure digital download (Box or similar service).
6.3 Force Majeure
We are not liable for delays caused by circumstances beyond our reasonable control, including but not limited to technical failures, natural disasters, or health emergencies.
7. Revisions Policy
7.1 Included Revisions
Each service includes a specified number of revisions as detailed in the service description:
- Mixing: Up to 3 revisions
- Mastering: Up to 2 revisions
7.2 Revision Requests
Revision requests must be:
- Submitted during the revision process before final validation
- Clearly documented with specific feedback
- Within the original project scope
Once the final product is validated by the client, no further free revisions are available.
7.3 Additional Revisions
Revisions beyond the included number may be purchased separately at our standard hourly rate.
8. Intellectual Property Rights
8.1 Client Rights
Clients retain full ownership and rights to:
- Original compositions and lyrics
- Master recordings after full payment
- Artist name and brand identity
8.2 Euterpa Studios Rights
Euterpa Studios retains rights to:
- Production techniques and methods
- Compositions or co-compositions created during collaboration
- Use completed work in portfolio
- Receive credit as producer/engineer on releases
8.3 Copyright Compliance
Clients warrant that they own or have obtained all necessary rights, licenses, and permissions for all materials submitted. Clients indemnify Euterpa Studios against any copyright infringement claims.
8.4 Moral Rights
In accordance with French law (Code de la propriété intellectuelle), moral rights remain with the original creators and cannot be transferred.
9. Client Obligations
Clients must:
- Provide high-quality source materials in industry-standard formats (WAV, AIFF, or as specified)
- Ensure they have all necessary rights to submitted content
- Provide clear project specifications and reference materials
- Communicate revision requests clearly and promptly
- Meet agreed project deadlines for feedback and approvals
- Provide accurate billing information
- Not use services for illegal or infringing purposes
10. Right of Withdrawal (French Consumer Law)
10.1 14-Day Cooling-Off Period
In accordance with Article L221-18 of the French Consumer Code, consumers have the right to withdraw from the contract within 14 days without giving any reason.
10.2 Exceptions
The right of withdrawal does not apply to:
- Services fully performed with the consumer's prior express consent and acknowledgment that they will lose their right of withdrawal
- Customized digital content delivered in a non-tangible form once delivery has begun with express consent

11. Refund and Cancellation Policy
11.1 Track Consultation
Track consultation fees are fully refundable if you proceed with proposed fixing services within 30 days.
11.2 Standard Services
All purchases are final. Services are non-refundable once payment is made.
11.3 Rush Services
Rush service fees are non-refundable.
11.4 Unsatisfactory Work
If you are unsatisfied with the delivered work and included revisions do not resolve the issue, we will offer additional revisions at no charge on a case-by-case basis.
12. Warranties and Disclaimers
12.1 Service Quality
We warrant that services will be performed with professional skill and care in accordance with industry standards.
12.2 No Guarantee of Results
While we strive for excellence, we do not guarantee specific outcomes such as chart positions, streaming numbers, or commercial success.
12.3 Technical Requirements
Quality of final product depends on quality of source materials provided. We are not responsible for issues stemming from poor source material quality.
13. Limitation of Liability
13.1 Maximum Liability
To the maximum extent permitted by French law, Euterpa Studios' total liability for any claim arising from these Terms or our services shall not exceed the amount paid for the specific service in question.
13.2 Indirect Damages
We are not liable for indirect, incidental, special, or consequential damages, including but not limited to:
- Lost profits or revenue
- Loss of business opportunity
- Data loss (clients should maintain backups)
- Reputational harm
13.3 Exceptions
Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Any matter for which it would be illegal to exclude or limit liability
14. Confidentiality
We treat all client projects as confidential. We will not:
- Share unreleased music without permission
- Disclose project details to third parties
- Use client materials for purposes other than the agreed service
By using our services, clients authorize us to showcase completed work in our portfolio for promotional purposes.
15. Dispute Resolution
15.1 Amicable Resolution
In case of dispute, parties agree to first attempt amicable resolution through direct negotiation.
15.2 Mediation
If negotiation fails, parties may agree to mediation before pursuing legal action.
15.3 Consumer Mediation
In accordance with Article L612-1 of the French Consumer Code, consumers may contact a consumer mediator:

15.4 Jurisdiction
Any legal action must be brought before the competent courts of Marseille, France.
16. Termination
16.1 Termination by Euterpa Studios
We reserve the right to terminate services and refuse future business if:
- Client violates these Terms
- Client provides false information
- Client engages in abusive or threatening behavior
- Payment is not received as agreed
- Client uses services for illegal purposes
16.2 Effect of Termination
Upon termination:
- Outstanding payments become immediately due
- Work-in-progress will not be delivered
- No refunds will be provided for completed work
17. Data Protection and Privacy
We process personal data in accordance with GDPR and French Data Protection Act. Please refer to our Privacy Policy for detailed information about how we collect, use, and protect your data.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable under French law, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Euterpa Studios regarding the use of our services.
20. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. The "Last Updated" date indicates when the Terms were last revised.
Continued use of our services after changes constitutes acceptance of the new Terms. For material changes affecting ongoing projects, we will notify clients via email.
21. Language
These Terms are provided in English and French. In case of discrepancy between versions, the French version shall prevail in accordance with French law.
